Subject:    MODIFIED ASSURED CAREER PROGRESSION SCHEME (MACPS) FOR THE CENTRAL GOVERNMENT CIVILIAN EMPLOYEES - CLARIFICATIONS REGARDING.






           
The undersigned is directed to invite reference to the Department of
Personnel and Training Office Memorandum of even number dated the 19th May,
2009 regarding the Modified Assured Career Progression Scheme (MACPS).
Consequent upon introduction of the Scheme, clarifications have been sought by various Ministries / Departments about certain issues in connection with
implementation of the MACPS. The doubts raised by varlous quarters have been
duly examined and point-wise clarifications have accordingly been indicated in the Annexure.



2 The MACPS should strictly be Implemented in keeping wlth the Department of
Personnel and Training Office Memorandum of even number dated 19/05/2009 read
with the aforesaid clarifications (Annexure).



3. All Ministries / Departrnents may give wide circulation to the contents of this O.M. for general guidance and appropriate action in the matter.

1. 1 Whether the Pay Band would change in the hierarchy of Pay Bands & Grade Pay on grant of the benefits under MACPS? Yes. The upgradations under MACPS is to be granted in the immediate next higher grade pay in the hierarchy of recommended revised pay (band and grade pay as prescribed in the CCS, (RP) Rules,

2008.
2. Whether the benefits of MACPS would be allowed to the Government servants who have been later on inducted in the Organized Group “A” Service No. The benefits under MACPS is not applicable to Group ‘A’ officer of Organised Group ‘A’ Services, as the officer under Organized Group ‘A’ Services have already been allowed panty of two years

on non-functional basis with the officers of Indian Administrative Service (IAS)
3. How will the benefits of ACP be granted if due between 01.01.2006 and 31.08.2008? The new MACPS has come into existence w.e.f. 01.09.2008. However, the pay structure has been changed w.e.f. 01.01.2006. Therefore the previous ACPS would be applicable in the new pay structure

adopted w e f . 01.01.2006. Para 6.1 of Annexure-1 of MACPS is only for exercising option for coming over to the revised pay structure and not for grant of benefits under MACPS. The following

illustrations would explain the position:


(A) In the case of isolated post:



Date of appointment in entry Grade in the pre-revised pay scale of Rs.4000-6000: 01.10.1982



1st ACP granted on 09.08.1999 :

Rs.4500-7000 (pre-revised)



2nd ACP due on 01 10 2006 :

Rs.5000-8000 (pre-revised)

[revised PB-2 Grade Pay of Rs.4200]




3rd financial upgradation under the MACPS would be due on 01.10 2012 (on completion of 30 years of continuous regular service) in the immediate next higher grade pay in the hierarchy of

recommended revised pay band and grade pay i.e. Grade Pay of Rs.4600 in PB-2.



(B) In the case of normal promotional hierarchy:



Date of appointment in entry Grade in the pre-revised pay scale of Rs.5500-9000: 01.10.1982



1st ACP granted on 09.08.1999 :

Rs.6500-10500 (pre-revised)



2nd ACP due on 01.10.2006 (as per the existing hierarchy) :

Rs.10000-15200 (pre-revised).



Therefore, 2nd ACP would be in PB-3 with Grade Pay of Rs.6600 (in terms of hierarchy available):



3rd financial upgradation under MACPS would be due on 01.10.2012 in the immediate next higher grade pay in the hierarchy of recommended revised pay band and grade pay of Rs.7600.
4. Whether the benefits of MACPS would be granted from the date of entry grade or from the date of thew regular servlce/approved service counted under varlous service rules The benefits under MACPS would be available from the date of actual joining of the post in the entry grade.
5. In a case where a person is appointed to an ex-cadre post in higher scale on deputation followed by absorption. whether the period spent on deputatlon perlod would be counted as continuous servlce in the

grade or not for the purpose of MACPS
(i) Where a person is appointed on direct recruitment/deputation basis from another post in the same grade, then past regular service as well as past promotions/ACP, in the earlier post, will be counted for

computing regular service for the purpose of MACPS in the new hierarchy.



(ii) However, where a person iS appointed to an ex-cadre post in higher scale initially on deputation followed by absorption, while the service rendered in the earlier post, which was in a lower scale cannot be

counted, there is no objection to the period spent initially on deputation in the ex-cadre post prior to absorption being counted towards regular service for the purposes of grant of financial upgradation under

MACPS, as it is in the same Pay band/grade pay of the post.
6. Whether the pay scale/grade pay of substantive post would be taken into account for appointment/selection to a higher post on deputation basis or the pay scale/grade pay carrying by a Government servant

on account financial upgradation(s) under ACP/MACP Scheme
The pay scale/grade pay of substantive post would only be taken into account for deciding the eligibility for appointment/selection to a higher post on deputation basis.
7. In a case where 1st/2nd~ financial upgradations are postponed on account of the employees not found fit or due to departmental proceedings, etc. whether this would have

consequential effect on the 2nd/3rd financial upgradation or not.
Yes. If a financial upgradation has been deferred/postponed on account of the employee not found fit or due to departmental proceedings, etc.. the 2nd/3rd financial upgradations

under MACPS would have consequential effect. (Para 18 of Annexure-1 of MACPS referred).
8. In a case where the Government servant have already earned three promotions and still stagnated in one grade for more than 10 years, whether he would be entitle for any further upgradation under

MACPS
No. Since the Government servant has already earned three promotions, he would not be entitled for any further financial upgradation under MACPS.
9. Whether the pre-revised pay scale of Rs.2750-4400 in respect of Group ‘D’ non matriculate employees, would also be taken as merged to grade pay of Rs.1800 for the purpose of MACPS in view of merger of

pre-revised pay scales of Rs.2550-3200, Rs.2610-3540, Rs.2610-4000 and Rs.2650-4000, which have been upgraded and replaced by the revised pay structure of grade pay of Rs.1800 in the pay band

10. If a Govt Servant on deputation earns upgradation under MACPS in the parent cadre, whether he would be entitled for deputation (duty) allowance on the pay and emoluments granted under the MACPS or not?

No. While eligibility of an employee for appointment against ex-cadre posts in terms of the provisions of the RRs of the ex-cadre post will continue to be determined with reference to the post/pay scale of

the post held in the parent cadre on regular basis (and not with reference to the higher scale granted under ACPS/MACPS). such an officer, in the event of his selection, may be allowed to opt to draw the pay in

the higher scale under ACP/MACP Scheme without deputation allowance during the period of deputation, if it is more beneficial than the normal entitlements under the existing general order regulating

pay on appointment on deputation basis.
11. Since the pay scales of Group “D” employees have been merged and placed in the Grade Pay of Rs.1800, whether they are entitled for grant of increment @ 3% during pay fixation at every stage. Yes. On the analogy of point 22 of Annexure-1 of MACPS, the pay of such Group “D” employees who have been placed in the Grade Pay of Rs.1800 w.e.f. 01.01.2006 shall be fixed successively in the next

three immediate higher grade pays in the hierarchy of revised paybands and grade pays allowing the benefit of 3% pay fixation at every stage.

  1. A person appointed as Clerk on 13.9.1988 and got first promotion as Sr. Clerk on 22.10.1990. Since He was given first promotion on 22.10.1990, He is entitled for 2nd and 3rd financial upgrading under MACP rules w.e.f. 22.10.2000 and 22.10.2010 respectively. Although, under restructuring scheme he been placed in next grade of Hd. Clerk w.e.f. 1.11.2003. Now he will be entitled for 3rd financial upgrading under MACP w.e.f. 22.10.2010 or after completion of 30 years of service or by 1.11.2013. Clarifications now issued are still incomplete and confusing. Related officials to do some needful in this matter. In the above example, some senior perons who have been promoted in the last 6-7 years are being denied 3rd MACP, whereas the persons who have not been promoted in the last 20 years, have been granted higher GP under MACP. How, it is possible. Should any body look into it.

    It is, therefore, requested to please issue necessary orders for 3rd financial upgrading under MACP w.e.f. 22.8.2010.

  2. Most of the staff nurses and pharmacists working in CGHS under the ministry of health & family welfare have not been sanctioned MACP till date, though they are eligible to get it. Even some of them from September 2008 as per the OM No-35034/3/2008-Estt.(D) Dated 19th May,2009 for immediate implementation.This is harassment to those staff from the concerned department.Can any one suggest what to do in such circumstances.

  3. Govt. may issue order to implement MACP immediately in all ministries / department to the eligible employees without further delay or a penalty to be imposed on officers for making such a long delay.

I was appointed in Dec 1987 (KVS, M/o HRD, GoI) (Shifted to Autonomous body, M/o MSME, GoI in the year Dec 1989) (Hyderabad) in the scale of 1400-40- and got in the promotion in the year Oct 2001 in the pay scale Rs.5500-9000 (Group B post). So far I have not got any ACP/MACP except one promotion in Oct 2001. When I will get ACP/MACP and scale of Pay after up gradation. Pl clarify

  6. My query is inconnection with clarification on ACP/MACP given by DOPT on 09 sep 10.
    Our hierarchy of posts/promotions are 5500 to 6500 to 10000 in pre revised.i was appointed in 5500 in oct 1988.i got first ACP/MACP in oct 2000 in 6500 and promotion in same 6500 in 2006.i am entitled for second ACP/MACP in Oct 08. kndly clarify whether i will get 6600 in hierarchy of old 10000 OR 4800 GP as mere replacement. recent govt clarification is clear about cases falling between the period of 01 jan 06 to 31 aug 08.

  8. Entry Grade:Gr-III Steno in 1980
    Ist promotion: PA in 1988
    2nd promotion: PS in 2004
    NFPS after 4 years as PS: 2008
    in PB-3 with GP 5400
    Will complete 30 years in : 2010

    After 30 years of service in 2010, Will I be getting the 3rd Actual Financial Upgradation in the hierarchy of Grade Pays i.e. GP 6600/-?

    Would appreciate if someone who has understood this new order of clarification on MACP confirm the above?

    I joined as Stenographer Grade-III in 1983. In 1996 my grade was upgraded by the Vth Pay Commission to Grade -II and in 2005 I got promotion to the post of Stenographer Grade-I. As per the 6th Pay Commission my pay was fixed in 9300-3450 with grade pay of Rs.4200/- Now i have been awarded 2nd ACP w.e.f. 1.9.2008 with Grade pay of Rs.4600/- can anybody say this is corre3ct or not.
    please carify at the earliest please.
    As per the latest orders on Ministry dated 10th September 2010 regarding MACP direct entry in the pay scale of Rs.5500 gets more pay than me .

  10. my appoinment ssw in 25.08.1987 and get sw in 31.05.1991 and promted to HS-II in 31.05.1994 and MCM in 20.05.2003.
    still now same MCM 2800 GP. In my 23 years service iwas got only one promotion HS only. How my fixation? we are awaiting for fast track(?) committee recomendation.

Please clarify whether I am elgible or not for any upgradation in MACP I have joined railway as SUP/P.Way in march 1996 in scale 1400-2300 I got two upgradation in 2003 and 2008 as JEII and JE I but in same grade pay 4200 Which is correspond grade of than scale 1400-2300 now all three post SUP,JE II and JE I merged in same grade pay and pay band

  12. i have joined in postman cadre on 08-04-1981 and got first regular promotion in PA cadre on 11-01-1994, till now i m working in this cadre and did not found any promotion. Am i eligble for 2nd MACP from 01-09-08 and in which grade pay. When i will get 3rd MACP

  14. it is really cruel if the past service rendered is not counted for the employees who have taken reversion for getting transfer and not granted the benefit of MACP on completion of 20 years / 30 years service including their original service in previous charge

  15. I WAS APPOINTED IN THE PAY SCALE OF RS 1400-2300 ON 15.03.1989. AS SUCH, I GOT IST ACP WEF 15.03.2001 IN THE SCALE OF RS 6500-10500 AND SECOND MACP IN THE GRADE PAY OF RS 4800/- WEF 15.03.2009. IN CASE, MACP WAS NOT INDRODUCED I WOULD HAVE GOT MY 2ND ACP ON 15.03.2013 IN THE GRADE PAY OF RS 5400/- BUT DUE TO ORDERS THAT THE PERSONS WILL BE PLACED ON IMMEDIATE NEXT GRADE I WILL BE GETTING GRADE PAY OF RS 5400 WEF 2019. DUE TO IMPLEMENTATION OF MACP, I AM AT LOSS.

  17. I have joined a Central Govt. Unit from an autonomous body the same Department on Departmental Transfer effecting only change of place. I have completed 10 years by Feb 2010 including the service of 6 years in my previous organisation (Autonomous Body under the Same Department). Can somebody clarify, whether I am eligible to get my first FUG.

  18. i have joined railway in SANDT department on 20-10-1983 in grade 260-400 as T.C.M.C and promote as T.C.M.B in grade 1200-1800 in august 1988.during this period i m direct selected thru R.R.B bhopal as A.S.M in grade 1200-2040 higher than 1200-2018 in april 1989 .so kindly inform me for M.A.C.P from where my service will be counted.

    What is the basic pay along with grade pay fixed for the employees got ACP/promotion on 01.01.2006 as assistant.
    The employees got ACP/promotion on 02.01.2006 get 7450-11500 (pre-revised) scale.

  20. Steno.Gr.III who has completed 10 years after 01.09.2008 are being granted Grade Pay Rs.2800/- under MACP Scheme as a first financial upgradation. Whereas the Steno.Gr.III who has granted first financial upgradation in old ACP scheme are now in Grade Pay Rs.4200/-. Is this an anomaly when both are doing same work? What can be way-out to get the same benefit.

    I would like to bring a few lines for your kind information. Sir, I have joined in the ICAR Services (Government of India under Ministry of Agricultural) as a Junior Clerk/LDC in November, 1985 and got only one Promotion as Senior Clerk/UDC in the Year of September 1992. After that I did not get any promotion till June 2007. In the year 2007 I took VRS on 01/06/2007. I have rendered the total Service of 21 years 7 Months. In my entire service, I got only one promotion. Sir, please tell me whether I am eligible to get the benefit of 2nd ASSURED CAREER PROGRESSION SCHEME. If I will be in service my Superannuation is in May 2021.
