Pursuant to the recommendations of the Sixth Central Pay Commission relating to
grant of Special Allowance, the President is pleased to device that the Special Allowance already admissible against specified posts would stand revised as indicated in Annexure-A.



2. These orders would be effective from 1st September 2008.



3. The rates of Special Allowances may be increased by 25% every time the Dearness Allowances payable on revised pay scales goes up by 50% except in the case of categories mentioned against item no.10 will be taken separately.



4. Special Allowance may be discontinued in respect of the categories indicated in Annexure ‘B’ with immediate effect.



5. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

Subject:- Implementation of New Pension Scheme - Release of 2nd installment of arrears of 6th CPC recommendations
to the post 1/1/2004 entrants.







Reference is invited to this Department's Office Memorandum of even number dated 17th August, 2009 wherein it was stipulated that the 2nd installment in respect of post 1/1/2004 entrants will be subject to the filling up of Physical Registration Form by the individual NPS Subscriber.




2. The OM dated 17/8/2009 was issued to ensure that subscribers fill in the Physical Registration Form so that the basic data viz. name, age, date of birth, address, etc. are updated in the PRAN account maintained by NSDL so that their PRAN Account gets activated. It is presumed that Physical Registration Form would have been filled up by now.



3. The 2nd installment of arrears on account of implementation of revised pay scales on the recommendations of the Sixth Central Pay Commission may be released to all the post 1/1/2004 entrants straightway.



4. In case there are any stray cases where data required by NSDL still remains to be obtained, it may be ensured that this may be sent ot NSDL by 30th November, 2009.

Subject: Payment of second instalment of arrears on account of implementation of Sixth Central Pay Commission's recommendations.






As communicated vide this Department's Resolution No.l/l/2008-IC dated 29th August, 2008, the Government had decided that the arrears on account of implementation of Sixth Central Pay Commission's recommendations will be paid in cash in two instalments - first instalment of 40% during the year 2008-09 and the remaining 60% in the financial year 2009-10. The first instalment has already been paid in 2008-09. It has now been decided that the remaining 60% of arrears may now be paid to the concerned Government servants.






2. Further, as already stipulated vide this Department's O.M. No 1 (2)/ EV/2008 dated 17th August, 2009, in the case of post - 0l.01.2004 entrants into the Central Government, the second instalment of arrears may be released only after individual application forms for registration to the New Pension Scheme have been obtained by the DDO/PAO from the concerned Government servant.






3. As in the case of the first instalment of arrears, Government servants will be permitted to deposit their arrears in their GPF Accounts. Though not mandated, Government servants are encouraged to deposit their arrears in their GPF accounts.

Subject: Implementation of New Pension Scheme – Pre-condition for release of 2nd installment of arrears of 6th CPC recommendations.




Reference is invited to this Department’s earlier Office Memorandums regarding implementation of NPS has been reviewed and the following action needs to be taken up immediately.




i. It has been intimated by NSDL that in a large number of cases pertaining to post 01-01-2004 entrants into Government service, the individual application forms for registration to the NPS have not been filled up and sent to them. It is therefore, advised that all employees under the administrative control of your Ministry/Department who are covered under NPS may be asked to fill up the enclosed form which may then be forwarded by DDO/PAO to NSDL immediately (latest by 31st August, 2009) if this has not already been done. Action in this regard will need to be completed before release of second installment of arrears for which separate orders will be issued. It may be noted that release of the 2nd installment, for post 1/1/2004 entrants, will be subject to the above action being completed.




ii. Further, the review has brought out that there are cases where the CDDOs/PAOs have not uploaded contribution files or (b) regular monthly credits have not been posted in the IRA or (c) there is mismatch of contribution. NSDL has been asked to forward PAO/DDO wise subscriber details which will become available to CDDOs/PAOs by the end of August, 2009. Suitable instructions may be issued to all the PAOs/CDDOs to verify the details/confirm contribution/Fund Transfer circulated by NSDL. Action as prescribed by NSDL/PFRDA while circulating these details (underlying action for missing credits) may be completed positively by 30th September, 2009.

Dear Comrades,


Anomaly and Standing Committee meetings.


There had been no formal or informal meeting with the Government either to discuss the anomalies or issues emanating from the implementation of the 6th CPC so far.

We had placed the items the staff side had sent for the consideration of the National anomaly committee (first instalment) on our website. The second and final set of items is likely tobe submitted in a day or two. As and when the same is finalized we shall place copy thereof on our website. We have received innumerable number of letters from our affiliates requesting us to take up the department specific anomaly items in the National Council. It is difficult to individually respond to these letters. Department specific items are to be pursued at the Departmental Anomaly Committees. Complaints have been received by us that many Ministries have so far not set up anomaly committees. We shall take up this issue with the Department of Personnel.


TUI PAE Conference at Brasilia.


The TUI PAE Conference was held this time at Brasilia in Brazil and Com. Sebastiano Soares has been elected as the General Secretary. We had placed a brief report of the Conference immediately after the inaugural session. We were awaiting for a full report from the newly elected Secretary General along with the resolutions and declarations adopted. But so far we have not been favoured with such a report from him. We therefore place below a brief resume of the deliberations at the Conference along with the declaration here below.


National Council meeting.


The National Council of the Confederation is due to be held in this month as indicated in our last communication. The available members of the National Secretariat of the Confederation met at New Delhi and it has been decided to convene the Council meeting either by the end of November, 2009 or in the first week of December, 2009 as per the availability of the hall etc The Council meeting will be held at New Delhi. The affiliates have been informed by our earlier communication of the subscription dues. However, none has chosen to make remittance. We shall once again request that the due may please be cleared immediately.


All India Convention of workers:


14th September, 2009.


The Sponsoring Committee of Central Trade Unions along with INTUC and BMS has decided to convene a National Convention on14th September, 2009. The main theme of the convention is to harness the support of the entire working class in the country against the neo liberal economic policies and the anti labour attitude of the Government. The extract from the communication we have received in this regard is given hereunder.


The meeting of the Central Trade Unions held on 19th July, 2009 at the INTUC H.qrs. at New Delhi expressed serious concern over;



*rising prices of essential commodities including food grains and vegetable creating severe hardship for the mass of the people


*continuing job losses resulting in loss of livelihood to millions of workers across the sectors owing to recession and economic slowdown


*non implementation of and rampant violation of basic labour laws pertaining to minimum wages, working hours, social security safety in workplace and trade union rights etc. throughout the country adding to the sufferings of the entire toiling people


*extreme inadequacy of the provisions and schemes under the un-organized workers sector workers including the contract workers owing to the restrictive provisions under the schemes and absence of any national fund for the un-organized sector(NAFUS) as recommended by the NCEUS and Parliamentary Standing committee on labour


*move of the Government for disinvestment of shares in profit making central public sector enterprises




The Central Trade Unions call upon the workers and employees and their unions irrespective of affiliation to unitedly highlight the concern over the above mentioned burning issues facing them and at the same time urge upon the Government to take urgent remedial corrective measures to address the aforesaid concerns of working people effectively.



The Central Trade Union decides to submit a memorandum to the Prime Minister on the aforesaid issues and hold a National convention of Trade Unions at Delhi in September, 2009 to chalk out common future programme.



Further details of the convention as to the Number of delegates the Confederation would be entitled to depute etc. will be available in our next circular letter.

Revision of pay scales of Faculty and Scientific/Design Staff as per 6th CPC




Revision of pay scales of Faculty and Scientific/Design Staff and other academic staff of Centrally funded technical institutions following pay revision of the Central Government employees on the recommendation of the sixth Pay Commission.



The Union Cabinet today approved the revision of pay scales of Faculty, Design & Scientific Staff and other academic staff of the Centrally funded institutions. The Cabinet also approved giving financial assistance to States for implementing the above revised scales.



This will enable the Institutes to recruit and retain talented and well qualified faculty and to provide them an environment and working conditions that encourage them to enhance their performance and capacity

SC panel seeks three-fold pay hike for trial court judges




In what could be the biggest ever salary hike for lowly-paid trial court judges, the Supreme Court-appointed National Judicial Pay Commission (NJPC) has proposed more than three-fold jump in their pay that translates to a monthly increase of Rs 20,000 at the entry level. Less than three months after being appointed head of the second NJPC, Justice E.Padmanabhan, a former judge of the Madras HC, submitted his report to the SC proposing an average 3.07-fold hike in the existing salaries that was recommended by the first NJPC in 1999.


The recommendations of the first NJPC headed by Justice Jagannatha Shetty had entitled civil judge (junior division) starting salary of Rs 11,775, civil judge (senior division) Rs 15,200, district judge (entry level) Rs 20,800 and district judge (super time scale) Rs 23,850. With the increase proposed by the second NJPC, the starting salary of a civil judge (junior division) is expected to be around
Rs 35,000, a hike of nearly Rs 24,000. As per Justice Padmanabhan’s recommendations, salary of civil judge (senior division) would be around Rs 45,000, which means a hike of around Rs 30,000. Similarly, the salary of district judge (entry level) would be around Rs 60,000 and that of DJ (super time scale) Rs 70,000. The logic given by Justice Padmanabhan, after extensive research and hearing of parties almost on a daily basis, was that the first NJPC had recommended salaries of the lower judiciary keeping in view the then salaries of HC judges which was fixed at Rs 26,000 and that of HC CJ at Rs 30,000, SC judges at Rs 30,000 and CJI at Rs 33,000.



However, with the CJI and SC and HC judges getting more than three-fold hike in their salaries,
the second NJPC thought of applying the same logic for trial court judges. The salary structure for the higher judiciary got changed with retrospective effect, as the government in January this year agreed to revise the salary of HC judges to Rs 80,000, HC Chief Justices Rs 90,000, SC judges Rs 90,000 and CJI Rs 1 lakh. The appointment of the second judicial pay commission had come through a judicial order of the apex court on April 30 in an application filed by the All India Judges Association.

Centre working on next-best option to one-rank, one-pay




The government seems all set to upwardly revise pension of ex-servicemen to bring them closer to the long-demanded “ one rank, one-pension” mechanism.



Though holding that full OROP is neither financially nor administratively possible, the government promises to resolve the existing anomalies in the pension structures of ex-servicemen which have been accentuated by the 6th Pay Commission.



On Thursday, cabinet secretary K M Chandrasekhar, who heads the committee of secretaries (CoS) looking into the issue, made a presentation to Prime Minister Manmohan Singh. He is also said to have discussed the pros and cons of granting the OROP demand based on the nearly two-month study that the committee carried out on the subject.



Others present during the presentation included finance minister Pranab Mukherjee, defence minister A K Antony, home minister P Chidambaram and minister of state (personnel) Prithviraj Chavan. The UPA government has already committed itself to taking a decision on the subject by the end of June in President Pratibha Patil’s address to the joint sitting of Parliament on June4.



Just before the crucial fourth phase of polling on May 7, the defence ministry had declared that a committee headed by the cabinet secretary had been constituted to ‘‘reduce the gap in the pensionary benefits to officers and jawans, bringing it as close to OROP as possible’’.

Subject:- Revision of the rates of Deputation (Duty) Allowance/payfixation on appointment on the personal Staff of Ministers - regarding.

Consequent upon the implementation of the recommendations of thesixth Central Pay Commission, the President is pleased to decide that in supersessionof all earlier orders on the subject, the pay of employees who are appointed on the personal staff of Ministers will be regulated in the following manner: -



I. OFFICERS OF CENTRAL GOVERNMENT/AUTONOMOUS BODIES APPOINTED ON THE PERSONAL STAFF OF MINISTERS:



(i) When officers of the Central Government/Autonomous Bodies holding posts at lower levels or those who are not cleared for appointments at levels at which the post in the Personal Staff of Minister exists are appointed to higher posts, in addition to their basic pay, they may be allowed Deputation (Duty) Allowance at the rate of 15% of the basic pay subject to a maximum of Rs. 4000 per month.


(ii) As regards officers who go on deputation to equivalent and/or analogous posts on the Personal Staff of the Ministers, in addition to their basic pay, they may be allowed Deputation (Duty) Allowance in accordance with this Department's O.M. No. 2/22 (B)/2008-Estt. (Pay-II) dated 3rd September 2008 on the subject of "Grant of Deputation (Duty) Allowance - Recommendations of the Sixth Central Pay Commission".


(iii) In the case of officers of All-India Services and Organized Group 'A' Services who are appointed on the Personal Staff of Ministers under the Central Staffing Scheme, they may be allowed Central Secretariat (Deputation on Tenure) Allowance in accordance with this Department's O.M. No. 2/22(A)/2008-Estt. (Pay II) dated 3rd September, 2008 on the SUbject of revision of the rates of Central Secretariat (Deputation on Tenure) Allowance and Special Pay applicable etc. in the case of organized Group 'A' officers; and as per the provisions of relevant Pay Rules in the case of All-India Services officers.



II. OFFICERS FROM THE STATE GOVERNMENT/PUBLIC SECTOR UNDERTAKINGS APPOINTED ON THE PERSONAL STAFF OF MINISTERS:



In the case of officers from State Governments/Public Sector Undertakings, their terms of appointment may be governed by the orders contained in this Department's O.M. No. 2/29/91 - Estt. (Pay II) dated 5th January 1994. The rate of Deputation (Duty) Allowance payable in their case will be in accordance with this Department's O.M. No. 2/22(B)/200-Estt. (Pay-II) dated 3rd September 2008 on the subject of "Grant of Deputation (Duty) Allowance - Recommendations of the Sixth pay Commission".



III. OFFICERS FROM PRIVATE SECTOR APPOINTED ON THE PERSONAL STAFF OF MINISTERS:


In the case of officers from Private Sector appointed on the Personal Staff of the Minister, they may be granted the grade pay corresponding to the post in which they are appointed and their pay in the pay band may normally be fixed at the entry level pay prescribed for their grade pay vide Section II, Part A of First Schedule to the CSS (RP) Rules, 2008. However, where it is proposed to fix their pay by granting advance increment(s), the approval of this Department will have to be obtained.


2.Basic pay in the revised pay structure means the pay drawn in the prescribed pay band plus the applicable grade pay but does not include any other type of pay like special pay, etc.


3. These orders shall come into effect w.e.f. 1.9.2008.



4. Insofar as persons serving in the Indian Audit & Account Department are concerned, these orders issue after consultation with the Comptroller & Auditor General of India.

Subject: Travel entitlement for the purpose of Leave Travel Concession.



The undersinged is directed to refer to O.M. of even No.dated 23rd September, 2008 which says that the travel entitlements while on LTC and official tour / transfer will be the same but no daily allowance shall be admissible for travel on LTC. Subsequently, the Ministry of Finance, vide their O.M. No. 7(!) / E. Coord. / 2008 dated 10th November, 2008, had stipulated that in the case of travel on LTC for those entitled to travel by air, only the cheapest economy fare ticket will be allowed, irrespective of their entitlements on tour. A number of references are being received in this Department to restore the travel entitlements as per the O.M. dated 23rd September, 2008.


2. The matter has been examined in this Department in consultation with the Ministry of Finance and it has been decided to restore the travel entitlements for LTC as stipulated vide O.M. dated 23rd September, 2008. The Ministry of Civil Aviation may bring out a scheme on the lines of LTC 80 for travel by business class. The officers and / or their families amy chose to travel on LTC by any airline provided the face does not exceed the fares offered by NACIL (Air India) under their new LTC schmem for business class.


3. These orders shall take effect from the date of issue.

It is clarified that the reference to pay in this order relates to the pay drawn in the pay band.
Pensioners have an option to get their CGHS pensioners card made by either making CGHS contribution on an annual basis (Twelve months) or by making contribution for 10 (ten) years [120 (one hundred and twenty) months] for getting a pensioners CGHS card with life-time validity.



This issues with the concurrence of the Department of Expenditure vide its' Office Memorandum, No. 18(1)/EV/2009 dated the 17th April, 2009.

Tamil Nadu implements sixth pay commission recommendations




About 12 lakh Tamil Nadu Government employees will receive a 30 per cent hike in wages with the government deciding to adopt the recommendations of the Sixth Pay Commission.






The revised pay scales will be implemented with immediate effect and employees will get the revised pay next month, State Finance Secretary K Gnanadesikan told reporters here today.












The Government would incur additional expenditure of Rs 5,155.79 crore per annum due to the revised scales which will hike salaries of the employees by 30 per cent, he said.


"Currently Rs 14,000 crore has been incurred by government on salaries per annum while for pensioners it is at Rs 7,000 crore totalling a sum of Rs 21,000 crore. After the revised pay, it will be Rs 26,155.79 crore", he said.


Giving some salient features of the revision, he said, "emoluments like House Rent Allowance and City Compensatory Allowance will be doubled, while the same are granted for the first time to all employees on Special Time Scales of Pay including the noon meal workers".


As part of accepting the long pending request of employees, pensioners and family pensioners, the existing Medical Allowance has been revised from Rs 50 to Rs 100 per month.


Stating that ceiling limit of Death-cum-Retiring Gratuity has been enhanced from Rs 3.5 lakh to Rs 10 lakh on par with Central government, he said arrears in the pay revision after adjustment of interim arrears will be paid in three equal instalments. Daily allowance has also been doubled.


He said the implementation will be from January 2006, but monetary benefit would be given from Jan, 2007.

A reference is invited to this Department OM of even No. dated 24.04.09 on the above subject. As indicated at point (v) of para 1, the details of batch of the officers belonging to the Indian Administrative Service who have been posted at theCentre in the various grades of PB-3 and PB-4 w.e.f. 01.01.2006 as well as the date of posting of the officer belonging to the batch is annexed. Necessary action posting may be taken for grant of higher scale for the Officers belonging to batches Organized Group A Services that are senior by two year or more and have not so far been promoted to that particular grade.

No full pension on completion of 20 years - who retired before 2.9.2008

Subject:- Representations regarding.

The undersingned is directed to say that in accordance with the instructions contained in this Department'sO.M.38/37/08-P&PW(A) dated 2.9.2008, as clarified vide O.M. dated 11.12.2008, those Government servants who retired during 1.1.2006 to 1.9.2008 after completion of 33 years of qulifying service, will be eligible for full pension (i.e. 50% of the emoluments pay last drawn) or 50% of average emoluments received duringthe last 10 months, whichever is more beneficial to the retiring employee) and the pension of those Government servants, who retired before 2.9.2008 with qualifying service of less than 33 years, will continue to be proprotionate to the full pension based on their actual qualifying service.


2. A large number of representations/references are being received in this Department mentioning that the above provisions are not in accordance with the law laid down by the Apex Court and are in violation of Article14 of the Constitution. It has been suggested in these representations that the provision regarding payment of full pension on completion of 20 years qualifying service may be made applicable to the Government employees who retired before 2.9.2008 also.


3. These representations/references have been examined in consultation with Ministry of Finance and Ministry of Law.The instructions/clarifications issued in this regard are in consonance with the decision of the Government on therecommendations of the Sixth Pay Commission. The Government by accepting various recommendations of the SixthPay Commission took a policy decision to implement them from different dates. The Government decided to implement the above recommendations regarding pension from 2.9.2008 without dividing a single homogenous class of pensionersin to two groups and subjecting them to diffrent treatment. In view of the above and also in the light of the various decisions of the Hon'ble Supreme Court allowing the employer to fix a cut off date for introducing any new pension/retirement schemeor for discontinuance of any existing sheme, the decision of the Government in para 1 above is in accordance with the lawlaid down by the Apex Court and there in no violation of Article 14 of the Constitution.


4. In view of the above, no change is required to be made in the instructions already issued in this regard.


5. All references/representations received in this Department on the abve issue stand disposed off accordingly.
